Requirement for corrective action

If upon completing its audit the Autorité des marchés publics (AMP) finds that the enterprise does not meet all integrity requirements of the Act respecting contracting by public bodies, it may demand such corrective action as it deems necessary to satisfy those requirements.

The imposed corrective measures must address the identified issues and help the enterprise to enhance its integrity standards. However, corrective measures cannot be imposed if, at the conclusion of its review, the AMP determines that no effective corrective actions could restore the integrity of the business. In such cases, the business may be listed in the  Register of enterprises ineligible for public contracts (RENA).

In addition, if an administrator of a company is found guilty of an offense under Schedule 1 of the Act respecting contracting by public bodies, the only corrective measures that the AMP may impose must eliminate any control exercised by the director, officer, or shareholder over the business. In the case of a shareholder who exercises such control, the AMP may impose restrictions to the extent it deems necessary.
