Terms of Use

These terms of use apply to the on-line services offered by the Autorité des marchés publics (the “AMP”) requiring authentication through clicSÉQUR.

By accessing the AMP's on-line services, you acknowledge that you wish to send and receive documents electronically. You also agree to be bound by and to comply with the clicSÉQUR terms of use (consent given when registering for clicSÉQUR) and the specific terms and conditions indicated below. The privacy policy set forth herein forms an integral part of the terms of use for the AMP's on-line services.

In the event of inconsistency between the clicSÉQUR terms of use and the terms of use for the AMP's on-line services, the AMP's terms of use will prevail other than for authentication issues. 

The AMP may, at its absolute discretion, amend any part of these terms of use at any time. Each time you use the AMP's on-line services, please check whether the clicSÉQUR terms of use and the special conditions have been updated by referring to the “Last updated” above. You will be bound by any changes made.

The AMP may, at its discretion, suspend, cease or limit the use of any portion of the on-line services at any time without notice or liability.

Your responsibility

Use of the AMP's on-line services requiring authentication through clicSÉQUR does not change the legal qualification of the related requests or obligations. You will still be responsible for providing accurate information at all times and complying with all obligations incumbent upon you under applicable laws. All instructions or information provided through the AMP's on-line services will be deemed to have been given by you and should be carefully entered and reviewed.

Without limiting the clicSÉQUR terms of use, you should bear in mind that your account is strictly reserved for your own use since it is accessed through a code that only you are aware of. You are strictly prohibited from sharing your access code. In the event a respondent is authorized to give instructions or communicate documents to the AMP, the respondent must be appointed in accordance with the law. It is up to you to change respondent when necessary and to notify the AMP of the change promptly.

Your use of the AMP's on-line services must comply with the terms of use. You may download the content, copy it to another medium or print it but you must not change or delete any information. Any other use of the on-line services is prohibited without the AMP's written consent.

If you extract information from the secure on-line services site operated by the AMP, you must take all necessary steps to ensure the information is saved and stored securely. It is also strictly forbidden to use the AMP's on-line services when you have reason to believe that such use could expose the AMP's infrastructures to a virus or malware.

The AMP's responsibility

Although the AMP goes to great lengths to keep its portal reliable and secure, it cannot guarantee that the system will operate without interruption. In the event such an interruption occurs, the user will not be released from legal or regulatory obligations. The AMP's Information Centre can provide assistance during business hours from 8:30 a.m. to 5:00 p.m., Monday to Friday.

The AMP reserves the right to withdraw access from a user who fails to comply with the terms of use.

The laws of Québec and Canada shall apply and any dispute resulting from these terms of use shall be presented before a court of Québec or a federal court.

Under certain circumstances, the AMP may provide hyperlinks to other third party sites. The AMP is not able to alter, update, or control the content of these websites accessed by hyperlink or other means. The AMP does not approve the content of such sites and is not responsible for the products and services they offer. When you leave the AMP's on-line services, you may no longer be protected by a secure connection. Accordingly, you should carefully read the terms of use and privacy policies of other sites you visit.

Digital signature

When you use our E-Services, the AMP may sometimes send you documents bearing a signature known as a digital signature. With this signature, the person sending you a document by e-mail can confirm his identity, guarantee its integrity and establish a permanent link between the document and the signer.

Legal value of a digital signature

A digital signature on an electronic document carries the same legal value as a handwritten signature, pursuant to An Act to establish a legal framework for information technology.

To be able to use digital signatures, the AMP has adopted a public key infrastructure (PKI) in partnership with the certification authority Notarius – Technologies et systèmes d'information notariale inc.

How to validate a digital signature

To validate a digital signature, your Adobe® software, which helps you to open electronic documents, needs to be configured. Otherwise, it will not be possible to validate the digital signature or incorrect messages such as “Validity Unknown” will be generated.

We urge you to consult the section Validating digital signatures from the Adobe® website to determine how to configure Adobe® or verify its configuration.

Technical requirements

To make our on-line services easier to use, prevent dysfunctions and optimize functionality, Internet Explorer 8, Internet Explorer 9 and Firefox 3 and higher are supported.

When you use the AMP's on-line services, our servers temporarily store files known as “cookies” on your computer's hard drive. Cookies let us retain selected important information regarding your session only during the period when you are connected to our services. This ID information is necessary to maintain the integrity of connections between AMP on-line services and users.

Privacy policy

By using the AMP's on-line services, you agree to the collection and use of personal information by the AMP in accordance with the terms set forth in this section.

The AMP is subject to An Act respecting access to documents held by public bodies and the protection of personal information, (R.S.Q., chapter A-2.1). It has adopted policies and directives to ensure information is handled appropriately. The AMP has also adopted two codes of ethics and professional conduct.

Terms of use respecting on-line payment services

The AMP's on-line services allow you to pay fees on-line from our secure site. Since fees are payable in advance, credit cards are a secure way of paying amounts owed to the AMP. Clients of participating financial institutions may also use InteracR.

You must submit all information relating to the payment method you choose. The AMP will confirm that the transaction has been honoured.

Since the AMP does not store credit card numbers or banking information, you will have to enter some information again for your next transaction.
