Requirement for corrective action
If upon completing its audit the Autorité des marchés publics (AMP) finds that the enterprise does not meet all integrity requirements of the Act respecting contracting by public bodies, it may demand such corrective action as it deems necessary to satisfy those requirements.
This corrective action must be sufficient to resolve the identified issues and enable the enterprise to raise its level of integrity. If the AMP finds, for example, that the issues are systemic or that there are persons in controlling positions in the enterprise who do not meet the integrity requirements, it may add the enterprise to the Register of enterprises ineligible for public contracts (RENA) without imposing corrective action. This will prohibit the enterprise from being involved in any public contracts for five years.
In addition, if an administrator of a company is found guilty of an offense under Schedule 1 of the Act respecting contracting by public bodies, the only corrective measures that can be imposed on him by the AMP consist in the removal of this person as director and the person in control of the company subject to an integrity review. This provision is in line with one of the philosophies of the integrity regime, according to which the rehabilitation of companies is paramount.
